Introduction and Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you and TreasureTrail ("TreasureTrail", "we", "us", or "our") that govern your access to and use of treasuretrailgear.com and any related websites, mobile sites, applications, products, and services (collectively, the "Website"), and all purchases and transactions made through the Website. By accessing, browsing, or using the Website, or by placing an order with TreasureTrail, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the policies expressly incorporated by reference herein, including our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree to these Terms, you must not use the Website or place an order.
Definitions
In these Terms certain capitalized words have the following meanings: "Customer" or "you" means the person who browses, orders, or purchases through the Website; "Products" means any goods available for sale on the Website; "Order" means a purchase request submitted by you through the Website; and "Third-party supplier" or "fulfillment partner" means any external manufacturer, supplier, wholesaler, or logistics provider engaged by TreasureTrail to supply, package, or ship Products to Customers. Defined terms are used consistently throughout to ensure clarity and precision.
Eligibility, Age and Account Responsibility
You represent and warrant that you are at least eighteen (18) years of age, or that you are placing an Order under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. If you create a user account, you are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify TreasureTrail immediately of any unauthorized use of your account or any other breach of security. TreasureTrail shall not be liable for losses arising from unauthorized use of your account except to the extent caused by our own gross negligence or willful misconduct.
Full Disclosure; Remote Sales and Consumer Rights (Israel)
TreasureTrail is a merchant subject to Israeli consumer protection and distance-selling regulations. Prior to completing a purchase, Customers will be shown the applicable total price, including any shipping fees, applicable taxes where the seller collects such taxes, and a clear description of the essential characteristics of the Products. Under Israel's consumer protection rules for long-distance sales, Customers have statutory cancellation and refund rights; these statutory rights cannot be limited or waived by contract. TreasureTrail will comply with its statutory obligations regarding the provision of required information and the handling of cancellations and refunds. For more detail on statutory cancellation rights and practical instructions for exercising those rights, see Section 10 below and consult local guidance.
How Contracts Are Formed; Order Acceptance and Right to Cancel Orders
When you place an Order through the Website you are submitting an offer to purchase the Products specified in your Order. Receipt of your Order will be acknowledged by email; however, such acknowledgement does not constitute acceptance of your offer. Your Order will be accepted and a binding contract formed when TreasureTrail sends you a shipping confirmation email (the "Order Confirmation"), unless TreasureTrail explicitly communicates otherwise. TreasureTrail reserves the right to refuse or cancel Orders in its sole discretion, including when we are unable to obtain authorization for payment, when there is suspected fraud, pricing or listing errors, or when a Product is unavailable from a supplier. In the event TreasureTrail cancels your Order after payment has been processed, we will promptly refund the payment in accordance with applicable law.
Pricing, Payment Processing, Taxes and Duties
All prices displayed on the Website are denominated in United States Dollars (USD) unless explicitly stated otherwise. TreasureTrail utilizes enterprise-grade third-party payment processors to facilitate secure financial transactions; by submitting an Order, you grant irrevocable authorization to these processors to charge your designated payment method for the total transaction value. TreasureTrail reserves the absolute right to cancel any Order and issue a full refund in the event of a "Manifest Error"—defined as any instance where a Product is listed at an incorrect price due to typographical error, system glitch, or synchronization latency with our third-party suppliers. Furthermore, to combat "Friendly Fraud" and the rising cost of illegitimate chargebacks, the Customer agrees to exhaust all internal dispute resolution mechanisms by contacting TreasureTrail support at the email address provided above prior to initiating a formal dispute with a financial institution. In the event a Customer initiates a chargeback for a delivered and verified Product without prior good-faith communication, TreasureTrail reserves the right to recover the full transaction amount, plus administrative fees and legal costs associated with the dispute, and may black-list the Customer from all future transactions. We may, at our sole discretion, request additional identity verification (such as government-issued ID) for high-value orders to ensure the security of both the Customer and the business.
Shipping, Delivery and Carrier Issues
TreasureTrail provides international shipping through a network of logistics partners, with estimated delivery windows provided at checkout representing the best-faith estimates of the carrier. The "Risk of Loss" and legal title for all Products purchased through the Website transfer to the Customer at the moment the Product is handed over to the initial carrier. While TreasureTrail will provide reasonable assistance in locating delayed or misrouted parcels, we are not liable for shipments that are marked as "Delivered" by the carrier but are subsequently missing, stolen from a residence, or subjected to "Porch Piracy." In such instances, the Customer is solely responsible for filing a local police report and pursuing a claim with the carrier; TreasureTrail’s contractual obligation is fulfilled upon the carrier's digital confirmation of delivery. Customers are strictly responsible for providing precise and accurate shipping coordinates; any costs associated with "Returned to Sender" shipments due to address inaccuracy, refusal of delivery, or failure to pay local customs duties will be deducted from any potential refund. TreasureTrail is not responsible for the seizure, destruction, or delay of Products by customs authorities resulting from the Customer’s failure to comply with local import regulations or safety certifications in their specific jurisdiction.
Packaging, Third-Party Suppliers and Fulfillment Partners
TreasureTrail sources Products from independent third-party suppliers and fulfillment partners, including suppliers located outside Israel. Because Products are often shipped directly from these partners, packaging, labels, and commercial documentation (including declared item values and supplier names) may reflect the supplier or manufacturer and not TreasureTrail. TreasureTrail will, where commercially reasonable and upon request, ask suppliers to provide neutral or discreet packaging and limited documentation, but such requests are not always available or guaranteed. The fact that packaging, labels, or paperwork bears supplier information is not, in itself, a breach of these Terms and shall not alone constitute grounds for a claim beyond the normal returns process. This truthful disclosure is intended to reduce surprises for Customers and to set realistic expectations regarding fulfillment practices.
Multiple Shipments and Pickup Locations
Large or mixed Orders may be shipped in multiple packages from different fulfillment locations. Some carriers may deliver to local parcel depots or pickup points; in such cases Customers will be provided with instructions on how to retrieve their shipment and any applicable pickup deadlines. TreasureTrail is not responsible for fees or penalties charged by carriers or pickup locations where a Customer fails to collect a parcel within the specified timeframe.
Cancellations, Returns and Refunds — Statutory Rights and TreasureTrail Policy
Under Israeli law, Customers have statutory cancellation rights for distance sales; those rights are incorporated into this Section and cannot be contracted away. In addition to statutory rights, TreasureTrail offers the following store return policy: unused Products in original condition may be returned within fifteen (15) days of delivery for a refund or store credit, subject to the procedures set out in our Refund Policy. To exercise statutory cancellation rights or to request a return under the store policy, Customers must follow the notice and return instructions on the Website or in the Refund Policy. Refunds for cancellations and returns will be processed promptly and in accordance with applicable law; to the extent required, TreasureTrail will effect refunds within the timelines set by Israeli law for distance sales. Shipping costs for returns, except where the Product is defective or not as described, are the responsibility of the Customer unless we state otherwise. TreasureTrail reserves the right to refuse return requests that do not comply with the Refund Policy or where Products show evidence of use or damage inconsistent with the return reason.
Warranties; "No Warranty" and Statutory Protections
Except as expressly provided in a separate written warranty issued by TreasureTrail, Products are sold "as is" and TreasureTrail makes no express warranties regarding merchantability, fitness for a particular purpose, or non-infringement, except where such disclaimers are prohibited by law. Notwithstanding the foregoing, statutory consumer protections enforceable in Israel remain applicable and may not be waived; to the extent required by law TreasureTrail will honor such mandatory rights. If you believe a Product is defective or materially not as described, notify TreasureTrail promptly in accordance with the Refund Policy and we will work to resolve the matter.
Comprehensive Product Safety, Field Liability, and "Hold Harmless" Provisions
The Products sold through TreasureTrail, specifically high-performance metal detecting hardware like the MDX-900, are sophisticated electronic instruments intended for use in diverse outdoor environments. By purchasing and utilizing these Products, the Customer explicitly acknowledges that outdoor exploration involves inherent risks, including but not limited to physical injury, environmental hazards, and legal trespass. TreasureTrail shall not be held liable for any injury, loss, or death resulting from the Customer’s use of the Product in hazardous terrain, inclement weather, or proximity to unstable structures. Furthermore, the Customer agrees to indemnify and hold harmless TreasureTrail and its affiliates from any legal claims, fines, or penalties arising from the Customer’s failure to comply with local antiquities laws, trespassing on private or government property, or the accidental disturbance of underground utility lines, unexploded ordnance (UXO), or hazardous materials. It is the Customer’s sole and exclusive responsibility to ensure they have the legal right to detect in their chosen location and to operate the equipment in a safe, lawful manner according to the provided safety guidelines.
Professional/Commercial Disclaimer and Recreational Use Limitation
Unless otherwise specified in a separate, written commercial contract, all Products sold by TreasureTrail are marketed and intended for Recreational and Hobbyist Use Only. While the MDX-900 utilizes advanced search technology, TreasureTrail makes no guarantees, warranties, or representations regarding the "success rate" of any search or the discovery of any specific items, precious metals, or historical artifacts. TreasureTrail explicitly disclaims any liability for "Loss of Business Opportunity," "Loss of Potential Revenue," or "Commercial Failure" if a Customer utilizes our Products for professional treasure hunting, commercial surveying, or industrial pipe/cable location. The Product is sold as a tool of discovery, and the results of its use are entirely dependent on environmental conditions, user skill, and ground mineralization. By completing a purchase, the Customer accepts that the "Recreational Nature" of the Product means that "Failure to Find" or "Lack of Discovery" does not constitute a Product defect or grounds for a refund beyond the standard 15-day window for unused goods.
Intellectual Property and User Content
All content on the Website, including text, graphics, images, product descriptions, trademarks, logos, and software, is the property of TreasureTrail or its licensors and is protected by copyright, trademark, and other intellectual property laws. If you post reviews, comments, photographs, or other content to the Website, you grant TreasureTrail a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, translate, distribute, and display such content for the purpose of operating and promoting the Website and our business. If you believe your intellectual property rights have been infringed on the Website, please contact us at the email address above and provide sufficient information to evaluate the claim; TreasureTrail will respond in accordance with applicable law.
Prohibited Uses and Conduct
You may not use the Website to engage in illegal activity, fraud, or any conduct that interferes with the operation or security of the Website or the rights of other users. Prohibited conduct includes, without limitation, attempting to gain unauthorized access to our systems, distributing malware or harmful code, submitting false or misleading information, and using the Website for unlawful commercial activities. TreasureTrail reserves the right to suspend or terminate access to the Website, cancel Orders, and take any other measures it deems appropriate if a Customer breaches these Terms or engages in prohibited conduct.
Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless TreasureTrail and its officers, directors, employees, agents, service providers, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; (c) your misuse of the Website or any Products; or (d) any false or inaccurate information you provide to TreasureTrail.
Limitation of Liability
Except where prohibited by applicable law, to the maximum extent permitted by law TreasureTrail's total aggregate liability arising out of or relating to these Terms, the use of the Website, or the sale of any Product shall be limited to the purchase price actually paid by the Customer for the Product giving rise to the claim. In no event shall TreasureTrail be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, loss of data, or business interruption, even if TreasureTrail has been advised of the possibility of such damages. Nothing in this Section is intended to exclude or limit liability that cannot be excluded or limited by applicable law.
Governing Law, Venue and Dispute Resolution
These Terms, and any dispute arising out of or relating to them, shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. Subject to any mandatory consumer protection provisions to the contrary, the competent courts located in Israel shall have exclusive jurisdiction to resolve any disputes arising under or in connection with these Terms.
Force Majeure
TreasureTrail shall not be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by events beyond TreasureTrail’s reasonable control, including, but not limited to, acts of God, natural disasters, pandemics, labor strikes, transportation delays, customs inspections, acts of government, supplier shortages, or interruptions in carrier services. In such circumstances, TreasureTrail will use commercially reasonable efforts to notify affected Customers and to resume normal performance as promptly as practicable.
Assignment, Severability, Waiver and Entire Agreement
TreasureTrail may assign or transfer its rights and obligations under these Terms to any affiliate or successor entity without additional consent from Customers. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The failure of TreasureTrail to enforce any right or remedy under these Terms shall not constitute a waiver of that right. These Terms and incorporated policies constitute the entire agreement between you and TreasureTrail regarding the subject matter and supersede all prior or contemporaneous communications.
Changes to the Terms; Updates and Notice
TreasureTrail reserves the right to update or revise these Terms at any time by posting the updated Terms to the Website together with a revised "Effective Date." Unless otherwise stated, changes to the Terms will be effective immediately upon posting and will not apply retroactively to Orders already shipped, except as required by law or as expressly stated. It is your responsibility to review the Terms periodically; continued use of the Website after changes are posted constitutes acceptance of the revised Terms.

TreasureTrail employs commercially reasonable measures to protect Customer information against unauthorized access, disclosure, or loss. Promotions, Discounts and Gift Cards; Third-Party Links
All promotions, coupon codes, discounts, and gift card offers are subject to separate terms posted with the offer and may be limited, revocable, or discontinued at TreasureTrail’s discretion. The Website may contain links to third-party websites or services. TreasureTrail has no control over third-party content, and you access any third-party sites at your own risk. TreasureTrail does not endorse and is not responsible for third-party products, services, or privacy practices.
Practical Supplier and Packing Note (Operational Guidance for Customers)
Because many Products are fulfilled by third-party suppliers, Customers may receive shipments showing a supplier or manufacturer name and a declared item value required for customs. This does not affect the Customer’s rights under these Terms or under applicable consumer protection law. Customers who prefer discreet packaging may contact our support team prior to ordering, and TreasureTrail will endeavor to request neutral packaging from suppliers where commercially possible, but we cannot guarantee supplier compliance with such requests.
